FAQ What is an electronic signature?
What is an electronic signature?
An electronic signature is an electronic process to signify a person’s approval of terms, conditions, or an electronic contract document. Electronic signatures ensure the integrity of a signed document by confirming the time and date the document was signed, recording the IP (internet protocol) address of the person who signed the document, and by verifying that the document has not been changed since it was signed.
What is Authentisign? How does it work?
Authentisign is a secure online document signing service enabling multiple parties to participate and sign documents electronically. The service allows you to easily create an electronic signing and walks you through each step of the process, including naming the signing, adding the participants, uploading forms, and sending invitations for the signing. After sending the invitations to the signors (e.g., buyer/seller), you will receive email notifications after each participant signs the forms. An online dashboard allows you to view the signing history and the progress of each signing. After all participants have signed, all parties will receive a final electronic copy of the signed documents. View the Authentisign Overview Flyer for more information about the service.
What are the benefits using Authentisign?
Authentisign allows for convenience and efficiency when signing contract documents. In a real estate transaction, the buyer and seller are required to sign and initial many pages of a purchase and sale agreement, related addenda, and notice forms. Traditionally, a real estate broker would print out all of the contract documents and physically deliver the documents to their client in order to obtain their client’s signature. More recently, a real estate broker could send the documents to their client (by facsimile or e-mail), which requires their client to print out all the contract documents, sign them, and deliver the documents back to the broker. Both of these processes are time consuming and require paper, printers, and facsimile machines.
Authentisign allows a buyer or seller to log into a secured website to access and review contract documents and then place their electronic signature on the document where required. This process offers convenience and efficiency for both the real estate broker and his or her client and greatly reduces the amount of paper used in a real estate transaction.

Are electronic signatures legal?
Yes. On June 30, 2000, Congress enacted the Electronic Signatures in Global and National Commerce Act (the “Act”), to facilitate the use of electronic records and signatures in interstate commerce by ensuring the validity of contracts entered into electronically. The Act went into effect in October of 2000. The Act provides that “a signature, contract, or other record related to such transaction may not be denied legal effect, validity, or enforcement solely because it is in electronic form.” In addition, the Act states that “a contract, relating to such transaction may not be denied legal effect, validity, or enforceability solely because an electronic signature or electronic record was used in its formation.”
When can electronic signatures be used?
Authentisign can be used anytime to sign documents instead of faxing, scanning and emailing, or meeting in person. You can use Authentisign to electronically sign listing agreements, or to sign buyer representation agreements, with both buyers and sellers for purchase and sale agreements, or even with buyers and sellers in the same signing. Authentisign includes different participants types, allowing you to choose whether each participant is a signer (buyer or seller), a reviewer (listing broker, selling broker, or attorney), or a recipient of the final signed document (listing firm or selling firm).
How much will Authentisign cost?
Free to Leske Realty clients.
What happens when I sign from a different time zone?
Authentisign will use the time zone of the location where you are signing, regardless of your location. For example, if one of your participants signs from New York, the signing history will record the time and date of their signing in Pacific Standard Time if you created the signing in Washington State.
Can a person use Authentisign to sign documents as a power of attorney?
No. Power of attorney signatures must be in a specific format that cannot be created using Authentisign.
